Warranty
LIMITED WARRANTY
Nite Ize warrants that for two (2) years following the purchase of any Nite Ize Product that the Product will be free from defects in materials and workmanship under normal use. Nite Ize is not responsible for any problem, including any problem that would otherwise be a breach of warranty, caused by failures resulting from any abuse, misuse, accident, or negligent act or omission by you or by any third party, or for acts of nature. Nite Ize shall, at its sole and exclusive discretion, either repair or replace any Product not meeting Nite Ize's "Limited Warranty" that is returned to Nite Ize with proof of purchase. YOU ARE RESPONSIBLE FOR AND MUST PRE-PAY SHIPPING, HANDLING AND INSURANCE COSTS RELATING TO RETURNING PRODUCTS FOR REPAIR OR REPLACEMENT. Any replacement Product will be warranted for the remainder of the original warranty period or for thirty (30) days, whichever is longer.
The above remedies are the Consumer's exclusive remedies for breach of warranty.
Nite Ize does not warrant against damages or defects in accessories or components not manufactured by Nite Ize, or against damages resulting from such non-Nite Ize made products or components. Nite Ize passes on to Buyer the warranty it received (if any) from the maker thereof for such non-Nite Ize made products or components.
Subject to any applicable legislation that prohibits the following exclusions:
THE WARRANTY SET FORTH ABOVE IS THE ONLY WARRANTY MADE BY NITE IZE WITH RESPECT TO ITS PRODUCTS. NITE IZE MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, AND SPECIFICALLY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY OF FITNESS FOR A PARTICULAR PURPOSE. THIS WARRANTY ALSO EXCLUDES ALL CONSEQUENTIAL AND INCIDENTAL DAMAGES DUE TO ANY NITE IZE PRODUCT.
SOME LOCALITIES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR HAVE LEGISLATION THAT IMPOSES CERTAIN STATUTORY WARRANTIES THAT CANNOT BE EXCLUDED, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
